We are updating our Terms &
Conditions of Use
(“Terms”) and href="https://magicseaweed.com/docs/legal/57/privacy-policy/13095/">Privacy Policy, which apply to your use of
Magicseaweed products and services. These updates are made to clarify our terms and ensure that they remain
transparent for you, as well as to cover some changes resulting from internal reorganization efforts.

The updates, which are summarized below, will take effect on March 15, 2023. If you continue to use our products or
services on or after March 15, 2023, you agree to the new Terms and acknowledge the updated Privacy Policy.

Tell me more about the internal reorganization and what it means for me.

As you may know, MSW has been part of the Surfline\Wavetrak group of companies since it was acquired in 2017. In the
coming months, certain MSW assets held by our UK subsidiary (Wavetrak Limited), including MSW user data, will be
transferred to our US parent company (Surfline\Wavetrak, Inc.) as part of internal efforts to optimize our legal
entity structure and how we transact with customers across the Surfline\Wavetrak group of companies.

These are the major ways this change will affect you as a user once the transfer is complete:

  • Your agreement with the UK entity will be transferred to the US entity and the US entity will be the new party
    to the contract. Here is more information on the new party:

  • Once the transfer is complete, personal data of MSW users will be collected and controlled by our US entity.
    Until such time, personal data will be controlled and processed by both the UK and US entities. We have mechanisms
    in place to enable the lawful and secure processing of personal data by both entities.

What if I don’t want my data subject to the transfer?

If you would like to opt-out of having your personal data transferred to the US entity, you may do so by exercising
your data rights. Please reach out to support@magicseaweed.com if you
wish to exercise your rights.

It is important to note, that if you opt-out you will be unable to use MSW going forward.

Will MSW be making any other changes?

There are currently no additional changes to communicate. In the event there are future changes that will affect
your use of MSW, we will provide advanced notice to allow you to prepare for those changes and communicate if any
action is needed on your part.

What changes is MSW making to the Terms and Privacy Policy?

A summary of the nature of the updates is below. We encourage you to read the full Terms and Privacy Policy to
familiarize yourself with the changes.

Terms & Conditions of Use

  • Services Provided By Us: We have added new provisions to clarify the different types of service offerings
    provided by MSW (e.g., free vs. paid subscriptions), added more detail around how paid subscriptions are renewed
    and cancelled, and set forth our ability to change our Services over time.
  • Your Use of the Services: Users are only permitted to use MSW and our Services for their own personal
    use. We updated the Terms to clarify permitted uses and restricted uses and added more information around how
    users are billed for paid services.
  • Content and Intellectual Property Rights: The content available on MSW is protected by copyright and
    other intellectual property laws. We have added new provisions to clarify our ownership over the content and the
    scope of the rights granted to users to access the content.

    We do not claim ownership over any content that is submitted by users, such as photos uploaded to MSW or comments
    published on the site. However, to provide the MSW services, we need certain rights (known as a
    “license”) to use content submitted by users. The updated Terms include a license to user content to,
    among other things, aggregate and display user content on MSW as well as our group company sites.

  • Ending Services, Liability and Resolving Disputes: We have added more information about how the Terms may
    be terminated by us or users. These new Terms include provisions that affect your rights, including limitations on
    liability.

Privacy Policy

  • We have provided detail about how your personal data will be handled as we complete the asset sale between our
    US and UK entities. Once the transfer is complete, personal data of MSW users will be collected and controlled by
    our US entity. Until such time, personal data will be controlled and processed by both the UK and US entities. We
    have mechanisms in place to enable the lawful and secure processing of personal data by both entities.
  • A table with details about the categories of data we may collect, our basis for processing and how that data may
    be shared has been updated.
  • We have added more information about how we process information of US residents following new state data privacy
    laws coming into effect.

When do the terms take effect?

The updates to the Terms and Privacy Policy will take effect on March 15, 2023. Until that time, the current terms
remain in effect.

How do I accept or reject these terms?

Monthly Pro: By allowing your monthly MSW Pro subscription to renew before the effective date, you
agree to the new Terms and acknowledge the updated Privacy Policy. If you do not wish to accept the new Terms,
please go into your account to cancel your subscription. You will be unable to use MSW going forward if you do not
accept the new Terms.

Yearly Pro: You will be prompted in the MSW experience to accept the new Terms and acknowledge the
updated Privacy Policy before they take effect. If you do not accept the Terms, you will be unable to use MSW after
the effective date. If you wish to reject the new Terms and cancel your subscription, please reach out to Customer
Support at support@magicseaweed.com.

All other users: By continuing to use MSW after the effective date you agree to the new Terms and
will be subject to the updated Privacy Policy. If you do not wish to accept the new Terms, you will be unable to use
MSW.
